What Happens Without Compliance
Civil penalties up to $16,000 per violation (first offense), $42,500 (one prior violation within 5 years), or $70,000 (two+ prior violations within 7 years). Penalties assessed per violation and per affected person. Imposed by the Illinois Human Rights Commission per 775 ILCS 5/8A-104(K) (as amended by P.A. 104-0425). IDHR investigates charges. Private civil action with uncapped actual damages and attorney fees (775 ILCS 5/8A-104).
