Penalties for Non-Compliance

Civil penalties imposed by the Illinois Human Rights Commission per 775 ILCS 5/8A-104(K) (as amended by P.A. 104-0425): up to $16,000 (first violation), $42,500 (second within 5 years), $70,000 (two+ within 7 years). IDHR investigates charges; the Commission imposes penalties. Private civil action with uncapped actual damages and attorney fees (775 ILCS 5/8A-104).
