Montana MCDPA — Consumer Data Privacy
Montana's privacy law has some of the lowest applicability thresholds in the country. If your business processes personal data from Montana residents — even a relatively small number — you may be in scope. This package covers the data protection assessment and privacy notice requirements.
Penalties for Non-Compliance
Montana Attorney General enforcement via Title 30, ch. 14, parts 1–2. No private right of action (§ 30-14-2817(5)). Civil penalty up to $7,500 per violation (§ 30-14-2820). 30-day cure period (§ 30-14-2817(3)). Data protection assessments not retroactive to pre-January 1, 2025 processing.

Who Must Comply
Entities doing business in Montana or targeting Montana residents that (1) process personal data of 25,000+ consumers/year OR (2) derive 25%+ revenue from data sales and process data of 15,000+ consumers (§ 30-14-2803). Lowest thresholds of any state privacy law.
